Over the course of my career as a litigator, I was counsel of record in three mass arbitrations, which totaled over three hundred individual cases. I took many of those individual arbitration cases through the merits hearing and final award, winning some and losing others. I settled the rest, using the "precedent" set by my wins and/or losses to value those settlements. Some of those settlements even applied class action principles to give the employers class-wide releases. Though exhausting and extremely time consuming, my experience with mass arbitrations has given me a unique viewpoint in this increasingly common area of the law. So, when approached by ARC to develop a CLE course about litigating mass arbitrations, I jumped at the opportunity to share some of my knowledge.
